Activities of LactaScreen BV:

• LactaScreen BV reports the presence of Human Milk Oligosaccharides (HMOs) in breast milk.
• LactaScreen BV guarantees careful reporting, but does not provide medical advice based on the result.

1. General Terms and Conditions.
   • LactaScreen BV is located in Groningen and registered under Chamber of Commerce number 8807150
   • Client: anyone on whose behalf LactaScreen BV analyzes breast milk
   • Assignment: all work carried out by LactaScreen BV on behalf of the client.
   • Report: the results of the research presented by LactaScreen BV
   • Breast milk test: consisting of a tube with screw cap and barcode, pipette, cold pack, return envelope with return address and postage costs including instructions.
   • Manual: instructions included in the breast milk test.
   • Total fee: the total price including VAT for analyzing breast milk.

2. Applicability
   • These general terms and conditions apply to all our deliveries and services, assignments. Dutch law exclusively applies to all rights, obligations, offers, assignments and agreements to which these general terms and conditions apply, as well as to the conditions.
   • Anyone who has breast milk analyzed by LactaScreen BV and places an order online declares to agree with the provisions in these General Terms and Conditions.
   • The general terms and conditions apply to all agreements regarding online assignments between LactaScreen BV and the client.
   • LactaScreen BV has the right to change these general terms and conditions and the content of its website at any time.

3. Assignment
   • An assignment is established after a client places an order for a breast milk analysis via the LactaScreen BV website and this assignment is accepted by LactaScreen BV through an order confirmation.

4. Collection and shipping of breast milk
   • The client is responsible for the collection of breast milk, packaging, freezing and shipping in accordance with the LactaScreen BV manual.
   • If the breast milk or materials arrive damaged at the laboratory due to transport, or are lost, a new breast milk test will be sent once without charge.

5. Results and reporting
   • After the laboratory research, the client will receive a report from LactaScreen BV as soon as possible.
   • This report is sent via email, and can be supported by a consultation upon request

6. Prices
   • All prices are in Euros and include VAT and shipping costs.

7. Assignments
   • LactaScreen BV guarantees that the assignments delivered by them meet the requirements of Good Laboratory Practice (GLP).
   • Immediately after the order, the client receives a confirmation by e-mail containing the order overview and total costs.

8. Cancelling assignments
   • It is possible to cancel an assignment within 24 hours after the assignment has been placed.
   • Costs incurred will be charged. The cancellation fee is 50 euros.
   • The breast milk test cannot be returned.

9. Liability
   • LactaScreen BV cannot be held liable for any damage, whether physical, material or immaterial, which after delivery, due to malfunctioning or incorrect use of the measurement kit and result supplied by us or for any other reason, has occurred to the client, to the client’s property, to the client’s family members, to property of the client’s family members, to third parties or to property of third parties.
   • The content of the website has been compiled with the utmost care. However, LactaScreen BV cannot exclude that certain information is incorrect or incomplete. LactaScreen BV is not liable for the consequences of incorrect or incomplete information on its website.
   • LactaScreen BV hereby excludes any responsibility for any damage that would result from malfunctioning or incorrect use of the assignments sold by us.
   • When LactaScreen BV is liable for consequential damages due to a defective result, LactaScreen BV’s liability is limited to replacement of the sent measurement package or refund of the purchase price. Moreover, LactaScreen BV is not liable if the damage is caused by intent or failure to observe the instructions of the breast milk test kit, or by improper use by the client.
   • LactaScreen BV accepts no liability for the incorrect transmission of verbal information, explicitly including research results and/or outcomes, provided advice and supplied data. LactaScreen BV also accepts no liability for the incorrect transmission of messages (such as fax or email) and consequences of disruptions in infrastructural communication lines or related quality or malfunctions of receiving equipment, including electronic information carriers, internet, or email.
   • LactaScreen BV reserves the right to, at its own discretion, suspend or terminate the execution of the order by notifying this in writing and without LactaScreen BV being obliged to pay any compensation.

10. Personal Data and Use of Results
    • All personal data is processed anonymously by LactaScreen BV and is not provided to third parties.
    • For the protection of personal data, please refer to the Privacy Statement of LactaScreen BV.
    • LactaScreen BV reserves the right to use the analysis results and milk samples for research purposes.

11. Questions and Complaints
    • If you have any questions or complaints about LactaScreen products, you are requested to make this known via email to info@LactaScreen.com

12. Copyright of Image and Text Material
    • It is not permitted, without written permission, to copy, store, publish, simplify or otherwise use text and/or image material.

13. Intellectual Property
    • Intellectual property of the analysis data, analysis methods, databases, logo, and design of the breast milk test kit rests with LactaScreen BV. The client does not obtain the right to use these rights unless explicitly agreed otherwise.
